Land Protection Options 

Donate Your Land

Donating your land is one of the most direct ways to ensure its permanent protection. When you donate property to the Niagara Land Trust, ownership is transferred to the Niagara Land Trust, which assumes responsibility for its long-term care and stewardship.

Donated land may be eligible for significant tax advantages through Environment and Climate Change Canada’s Ecological Gifts Program. Landowners can receive a charitable tax receipt for the full appraised value of the land, which can be applied to up to 100% of annual taxable income and carried forward for up to 10 years. In addition, capital gains tax that would normally apply to the disposition of the property may be eliminated.

Establish a
Conservation Easement

A Conservation Easement Agreement (CEA) allows you to protect your land while retaining ownership. This voluntary, legally binding agreement limits certain types of development to preserve the property’s natural features.

Easements are registered on title and remain in place for all future owners. You can continue to live on, use, and sell your property with the assurance that it will be protected permanently.

Because you are donating certain rights to your land, conservation easements may also provide tax benefits. Landowners can receive a charitable tax receipt based on the value of the easement, and in some cases, may qualify for additional tax relief through the Ecological Gifts Program.

Leave a Legacy Gift

You can also choose to protect your land through your estate by naming the Niagara Land Trust as a beneficiary in your will.

This option ensures your land is conserved in perpetuity while also providing tax benefits to your estate. The value of the donated land is eligible for a charitable tax credit, which can help offset taxes owing, including capital gains, and maximize the value passed on to your beneficiaries.
